NEW DELHI: Information and Broadcasting Secretary Uday Kumar Varma, while reiterating that the sunset dates of the first phase for the metros of 30 June was irrevocable, said today that the regulatory framework including interconnection issues and tariff for cable digitisation would be in place by the end of this month.

Varma said that one million digital set top boxes had already been installed while another 2.5 million were readily available and the process of acquiring the remaining seven million required for the first phase had been put in place with directions issued for importing them.

Earlier last week, Additional Secretary Rajiv Takru had claimed that ten million STBs were already available for the first phase.

Varma described the present phase of growth in broadcasting as very exciting and said the country was on the threshold of a second information revolution which would lead to financial returns and extraordinary benefits. However, he said this was possible only with synergy between the government and the industry while keeping the interest of the common man in perspective. There was need to move with confidence, conviction and purpose.

Delivering the inaugural address at the one-day meet on ‘Beyond Digital’ organised by the Cable and Satellite Broadcasters Association of Asia (Casbaa), he said there was need to sensitise all the stakeholders and the cable operators had to be proactive if this was to be done.

As far as the Government was concerned, the Task Force set up by it for this purpose was meeting every fortnight to review the situation, and the Telecom Regulatory Authority of India (Trai) was also working to finish the work assigned to it.

Meanwhile, he said the public service broadcaster had a definite role in this changing scenario and so special attention was being paid to ensure digitisation in All India Radio and Doordarshan so that it retains its eminence in the media. Special efforts were also on to help Doordarshan’s direct-to-home service, DD Direct Plus, to grow.

Speaking later in the afternoon, Joint Secretary Supriya Sahu said that television spots to promote the awareness about digitisation were ready and would be aired soon on all channels. She wondered why the Indian Broadcasting Foundation (IBF) and the News Broadcasters Association (NBA) had not come forward to prepare such spots.

Addressing a session on ‘Regulatory Mandate’, she said the rules under the amended Cable TV Networks (Regulation) Act had been finalised and would be notified soon. She said regulations have to keep pace with technology but the latter was changing very fast. The aim of the framework was only to create an enabling environment and a level-playing field. She assured the participants that consumers would have no problems if they wanted to change their service providers.

Referring to the large number of regulations and laws in the country on communication, she said there was need of synergy and convergence.

She claimed that the licensing procedure for cable operators and multi-system operators had been simplified under the rules.

Referring to the sunset date of 30 June, she said that the law now provided for punishment for those who did not comply but she was confident that such a situation would not arise since the whole exercise was in the interest of all the stakeholders.

Referring to sensitisation of producers, she said the Broadcast Content Complaints Council had recently held a meeting with creative directors and producers in an attempt to ensure better TV content, which was a very welcome step.

Answering a question about complaints being heard by the Inter-Ministerial Committee, she said these were only relating to channels which not members of the NBA or the IBF.

While asserting that the government wanted the cable sector to flourish, she said in answer to a question that there was no plan at present for creating any fund to help cable operators who did not have the resources for going digital.

Most of the speakers representing MSOs in the various sessions expressed confidence that the country would be able to switchover smoothly and there would be no shortage of STBs.

However, they regretted that the budget had failed to bring any incentives for the cable industry.

The DTH operators were not sure whether entertainment being put in the Negative List would benefit them, though some of them quoted a Delhi High Court judgment which had said watching programmes on DTH was akin to entering a cinema hall.

NEW DELHI: The direct-to-home (DTH) platforms have made a strong plea for doing away with the entertainment tax levied by the states and the 10.3 per cent service tax levied by the Centre.

The DTH Operators Association of India has said that the entertainment tax is unethical as only the broadcasters or those who generate programmes should be taxed.

Harit Nagpal, President of the Association, told indiantelevision.com that the entertainment tax varies from state to state and the average percentage was around 10 per cent.

Nagpal, who is MD and CEO of Tata Sky, said all the DTH players have to pay customs duty on set-top boxes (STBs) imported into the country, which was as high as 20 per cent. This was unethical when the country was resorting to digitisation.

All the DTH operators also had to a pay huge amount as licence fee.

Nagpal regretted that the industry had for long been hearing about Goods and Services tax (GST), but this had still not come into effect. He hoped that the Negative List to be prepared by the Finance Ministry will help the industry.

Meanwhile, Dish TV called for the basic customs duty on digital head-end and STBs to be reduced to zero for three years to give a boost to digital conversion.

In its demands from the Finance Ministry for the new budget, Dish TV also wants the double charge of service tax and entertainment tax to be subsumed in the GST. It said there should some relief in licence fee from the existing 10 per cent to 6 per cent as agreed by Telecom Regulatory Authority of India and the Information and Broadcasting Ministry.

Noting that Dish TV expects positive move from Government on taxation, it said there is heavy taxation on the DTH industry which is already paying multiple taxes such as service tax, entertainment tax, licence fee and VAT.

It added that the double charge of service tax and entertainment tax should be subsumed in GST.

Bharti Airtel CEO (DTH/Media) Shashi Arora said the high tax of 35 per cent in toto does not give the DTH sector impetus to grow at the high rate and help digitisation. Levying of service tax, licence fees, and entertainment tax in addition to customs duty makes the package expensive for the common user and also discriminates against analogue cable which is free from paying these taxes.

He told indiantelevision.com that the government should have a relook at Entertainment Tax which is as high as 25 per cent in some states.

Since a DTH setup is far more transparent as against a local analogue cable, Arora said this tax appears unfair and anti-DTH consumer. “We recommend the government brings in the Goods and Services tax (GST) and covers DTH under it,” he added.

He said there was currently a dearth of quality indigenous manufacturers of the STBs in India capable of the scale required for DTH. The number of manufacturers of chip sets in the world was also very small, of which only a handful are based out of India. Thus, 95 per cent of the demand for STBs is met via imports. In order to drive digitisation, the custom duty on digital STBs needs to be brought down.

Arora added: “We would also request an urgent rationalisation of the 10 per cent licence fee levied on the DTH platform. The bulk of the costs of the DTH operator is content, that is the money paid for carrying paid channels on the platform. It is our recommendation that either the calculation is changed to adjusted gross revenue subtracting the content cost from gross revenue or the amount brought down to 6 per cent of gross revenue. This will go a long way in enabling the industry to overcome its losses.”

He added: “Today, every DTH operator from the largest to the smallest is bleeding and the appetite for fresh investment will decline unless this is corrected quickly.”

Arora said the industry expected that allowing the use of infrastructure of DTH companies for catering to neighbouring countries (with the same infrastructure) should be deemed as exports of services.

He was confident that with the government’s support and reform-led approach, the DTH sector would be in position to usher in the second telecom revolution. “We hope for a progressive budget that is growth oriented in spirit,” he added.

INDORE: At a time when cable operators in the state are working hard to woo their subscribers to shell out more under the new tax regime, another issue has started haunting them.

A recent amendment to the Section 4A of the Cable Regulation Act, 1995 legalizes an ordinance issued in October this year for implementing mandatory addressable digitization (MAD) throughout the country in phased manner beginning from June 30 this year. Simply put, digitization means they will have to make heavy investment in buying equipment to switch to new technology.

By rough estimates, there are nearly 5,000 cable operators, who beam programmes to some 2.5 crore subscribers in the state. With changes in the rules of the game, the cable operators (which also cover multi system operators) will have to pay an entertainment tax at 20% of the turnover against the earlier existing system of Rs 20 per connection, in case it goes beyond Rs 5 lakh per annum effective from April 1 last year. The MSOs are likely to call on chief minister Shivraj Singh Chouhan soon to urge him to help them out on this front.

As per the existing system, most of the cable operators in the rural and semi-urban areas are relying on analog signal which doesn’t require any set top box (STB) at the time of providing cable connection to the subscriber. The cities with more than 10 lakh population like Indore and Bhopal will have to mandatorily shift to digitization by March 31 next year 2013, said a source familiar with the development.

Digitization means that there will be no any analog signals as these signals will be switched off after the cut-off date. The local cable operator will not be able to beam any analog signals. The TV would go blank if a viewer stuck to analog cable, added the source.

It is likely to give a boost to DTH players that are likely to witness a good chunk of analog cable subscribers switching to their digitized services. Videocon d2h is one such player, which enjoys one-fourth of the overall DTH subscriber base in the state. Saurabh Dhoot, director- Videocon d2h said, “As all consumers, currently on analog transmission, will have to shift to the digital space, it would essentially lead to a huge growth in the sector.”

Finally, digitalization is likely to bring in greater consolidation, reduced dependence on viewership ratings and drop in carriage fees. Shashi Arora, CEO -DTH/Media, Bharti Airtel, said, “We at Airtel digital TV are looking at maximizing the opportunity by offering better channel and non-channel content , stronger distribution and decentralized service capability for our target group.

NEW DELHI: The government is in the process of filing a civil appeal against the order of the Telecom Disputes Settlement and Appellate Tribunal (Tdsat) which applied the principle of adjusted gross revenue for determination of annual licence fee by direct-to-home (DTH) operators.

“The government is readying to file against the Tdsat order,” Information and Broadcasting Ministry sources told Indiantelevision.com.

An appeal is already pending in the Supreme Court against an earlier order in this regard on 26 August 2008. The latest order came on 28 May this year.

Incidentally, the DTH operators want the licence fee to be reduced, which they feel is seriously damaging their profitability. The sector is steeped in losses amid strong subscriber growth due to stiff competition among the six private DTH operators and low cable TV ARPUs (average revenue per user).

I&B sources said the government received Rs 1.262 billion for the year 2009-10 as licence fee as against Rs 893 million in 2008-09 and Rs 345 million in 2007-08.

The fee is presently based on the gross revenue – that is, the revenue earned from the sale of hardware such as set-top box (STB) and by way of charging carriage fee. This is defined in Article three of the Schedule of the DTH Licence Agreement.

Meanwhile, most operators have lauded the government’s efforts towards digitisation and expressed their willingness to support these measures.

The comments came in response to a Consultation Paper issued by the Telecom Regulatory Authority of India on the possibility of technical interoperability and technical compatibility among different DTH operators who have adopted the same or different standards.

The consultation paper was issued as the Information and Broadcasting Ministry had on 11 May requested Trai to review its recommendations “Interoperability and Other Issues relating to DTH” of 30 January 2008. In 2006, the Ministry sought recommendations of Trai on various issues related to a DTH licence. One of the issues included technical interoperability in case of set top boxes with recording facility, personal video recorder (PVR) or Digital video recorder (DVR). The Authority made some recommendations to the Ministry on 25 August 2006.

In its response, Tata Sky said both inter (in between) and Intra (within) operator interoperability is not possible amongst different DTH operators since they have been permitted over the last three years to adopt different standards. The Ministry has stated that if the DTH STB standard is to be revised, it should be such that ensures both Inter (in between) and Intra (within) operator interoperability.

It said the rationale behind technical interoperability – that customers should be able to switch from one DTH operator to another without having to purchase a new operator’s Customer Premises Equipments (CPE) – was understandable but not possible when there are as many as six private DTH operators apart from the free-to-air Doordarshan Direct Plus.

In any case, the cost of the CPE is no more prohibitive and all DTH operators have deployed substantial subsidies directly to all their subscribers. The fact that some DTH operators are providing STBs free of cost cannot be lost sight of in the present highly competitive context. Any new stipulation in the DTH license agreement that will push the cost of the CPE up is likely to lead to the withdrawal of free STB schemes, currently on offer. Thus, it is the customer who will be the ultimate loser.

Bharti Telemedia (Airtel Digital TV) has said that although the open architecture STB is technically feasible, it would lead to many issues and has cost implications as well. Any open architecture system to support all DTH operators would need additional features in the form of hardware and software support/modification to be added to the box and this would in turn escalate costs.

It has suggested that to support open architecture, there is a need to make an industry consortium which can work towards the common hardware and software solution/specifications for Interoperable STBs. Possibility of common smart cards can be explored so as to forfeit the need for CAMs and to bring down the cost of STBs.

It added that it is important that all future network and STBs manufactured/imported be consistent with the highest technical standard.

Any regulatory intervention should not stop the march of technology. In order to ensure that only the latest technology networks and STBs are deployed by the service providers, the regulator should specify the minimum standards with backward compatibility. This would avoid the deployment of obsolete technologies.

Bharti also said one of the most effective ways for the Government to safeguard the subscribers’ interests is to move towards a cost reduction for STBs.

According to its estimate, the average churn rate of DTH operators is close to 0.4 per cent and having the CI slot and CAMs in the STB only to provide the technical inter-operability and flexibility to this small percentage of DTH subscribers’ results in rise in the cost of the STB for all the DTH subscribers.

Thus, it is suggested that the STBs be manufactured with bare minimum features and without the Common Interface (CI) slot and other expensive functions so as to reduce the cost of STB. There should be withdrawal of customs duty, excise duty and other taxes currently levied on the import and manufacturing of STBs. This would bring down the overall cost of the STB and would make it more economical for DTH subscribers to buy a new STB instead of CAM module to switch between DTH operators. The government should support the cost reduction of STBs through allocation of funds and other rebates like tax holidays.

Videocon D2h has, on the other hand, said that the operator can move towards giving maximum flexibility to the subscriber only by moving towards true technical interoperability. But while commercial interoperability is justified for purchased STBs, it is not appropriate for rented boxes.

D2h also says it is possible to have an open Architecture based STB and claims it has already achieved this level of technical capability.

Dish TV says that no less that four operators are clustered around the 93.5E location on which Sun and DD-Direct operate. These operators also have common visibility of other satellites. This implies that using a common antenna, a customer without making any change in the rooftop antennas, can potentially receive services from more than one satellite provided that the set top box is interoperable. Even customers at other locations such as 88.5E or 83E can view one or more satellites with dual LNBs which are available inexpensively in the market.

However while customers have access to 3-4 satellites or more with the same dish or dual LNBs, they can view the channels on other DTH systems if they have an interoperable set top box with a CI slot and CAMs for other system. This is desirable as not all channels are available on all DTH systems. As an example certain cricket matches were available on only one DTH system and further not all DTH systems carry the same set of channels in SD or HD format.

It also says it is possible to have an open architecture based STB that could ensure technical interoperability and technical compatibility and effective interoperability among different DTH operators who have adopted same standard. Interoperability.

Reliance Big TV does not think there could be standardized interoperable STBs as each box is configured to receive a small number of network requirements to keep its cost low. Interoperability may also help the hackers to break into the networks.

In fact, it says implementation of technical interoperability could be detrimental to the interest of the customer since the cost of the STB with CI and CAM mandated by the BSI would be high.

STB interoperability means the STBs of any DTH platform should be usable on any other DTH platform. It will enable customers to switch from one operator to another on the same set top box by just using a module known as conditional access module (CAM).

The customer can simply insert this module into the STB to access another operator without using a separate STB.

Interoperability of STB was incorporated in the DTH licensing norms to give the consumers a choice. The clause says that the STB must be ‘inter-operable’, meaning the STBs should be compatible with all service providers.

The Telecom Regulatory Authority of India (TRAI) is looking to implement an open architecture system for the different DTH players and last month issued a consultation paper seeking feedback from the stakeholders.

In response, the country’s largest DTH player Dish TV favoured the proposed move, saying that portability is mandated by the law and should be implemented.

But other DTH operators say there are serious limitations to the technical inter-operability of the STB such as cost escalation.

‘To reduce the cost of the box, each box is designed to support a limited configuration based on network requirements of the provider. Any attempt for interoperability will increase cost for the subscribers without getting advantages of newer technology,’ said Reliance Big TV.

Tata Sky said different operators are using different combinations. If a single STB is to be made compatible with all different technologies such as compression technology, transmission technology and other encryption technologies, the cost is bound to go up significantly.

STB interopertability means the STBs of any DTH platform should be usable on any other DTH platform.

The clause says that the STB must be “inter-operable”, meaning the STBs should be compatible with all service providers.

“To reduce the cost of the box, each box is designed to support a limited configuration based on network requirements of the provider. Any attempt for interoperability will increase cost for the subscribers without getting advantages of newer technology,” said Reliance Big TV.

Tata Sky said different operators are using different combinations. If a single STB is to be made compatible with all different technologies such as compression technology, transmission technology and other encryption technologies, the cost is bound to go up significantly.

“The increased cost of an STB would defeat the very purpose of technical inter-operability, as the additional cost would have to be recovered from customers,” it said.

Currently, different service providers are using different technologies for distributing signals through the STB.

Bharti Telemedia echoed the views of Reliance Big TV and Tata Sky and said that commercial interoperability will be way better than technical interoperability.

“The operators who have installed base of STBs of an older version should endeavour to replace those STBs with the latest version so that the customer can enjoy interoperability. In light of the above, we believe that the commercial interoperability is more consumers friendly and should be extended to the consumers to get the refund of STB security as per prescribed scale,” said the operator.

DD Direct, TATA SKY, Dish TV fall in the first category and use DVB-S (Digital Video Broadcasting) modulation and MPEG (Moving Picture Experts Group)compression, a standard for the generic coding of moving pictures and associated audio information.

SUN Direct and Reliance Big TV fall in the second category and use DVB-S modulation and MPEG-4 compression, the better version of MPEG.

Videocon D2H, Airtel digital TV which falls in the third category work on DVB-S2 (second generation Digital Video Broadcasting) modulation and MPEG-4 compression.

While customers with third category operator can move to any operator, the customers in second category can move to an operator in the first and second category only. However, customers with first category operator can move to the other operators in the same category only.(IANS)

“The aim is to make the STBs as affordable as possible and drive digitisation. Rural markets is a big opportunity and a major portion of our monthly additions are coming from the smaller towns,” Tata Sky Chief Marketing Officer Vikram Mehra told PTI.

The price of Rs 999, which includes hardware and installation cost, will help add significant numbers to the subscriber base, he added.

Tata Sky, a JV between the Tata Group and STAR, was earlier offering the basic STBs at Rs 1,599. It claims to have about 5.5 million subscribers.

Tata Sky is one of the seven operators in the country, offering DTH services. Other players are Dish TV, Sun Direct, Airtel digital TV, Reliance BIG TV, DD Direct and Videocon d2h.

According to analysts, India has about 18 million DTH subscribers. Though still in its infancy stages compared to 80 million cable TV households, the DTH industry is growing at a rapid pace.

The competition in the DTH sector is expected to be fierce this year as operators expect to add 8-10 million subscribers in FY’11 due to a spate of sporting events like IPL and Commomwealth Games.

Over the last few years, operators have slashed STBs significantly along with free subscription for channels to get subscribers.

Asked if the company will cut cost of other STBs — Personal Video Recorder and High Definition, Mehra said, “That is not something we are working on. Wherever we can pass the benefit to the consumer, we do. You cannot overlook the tax burden and lack of a level-playing field with cable.”

They desperately want to increase bandwidth to host more channels and high-definition (HD) content. However, they may not be able to do so unless they migrate to a newer compression technology at a higher cost.

When the Indian Space Research Organisation (ISRO) launched the Indian National Satellite System, or INSAT, series of communications satellites for DTH service providers, the early movers (Dish TV and Tata Sky) got more transponders, while late entrants like Sun DTH, Big TV, Airtel DTH and Videocon d2H got fewer transponders.

Transponders are transceivers or repeaters on a communications satellite. They receive signals from the broadcasting (uplinking) centres, amplify the signals and send them back (downlink) to users (DTH subscribers).

However, Tata Sky and Dish TV started out with using the lower file compression platform of MPEG-2 in their set-top boxes. Sun DTH, Big TV, Airtel DTH, and Videocon d2h, on the other hand, use MPEG-4. MPEG is a file compression methodology. While both MPEG-2 and MPEG-4 are widely used for file compression, the latter has additional features.

In DTH operations, MPEG-4 offers better coding efficiency. Hence, the channel offerings of newer players are at par with that of the older players despite them having fewer transponders (in other words, they can add more channels despite having fewer transponders since the technology squeezes in more content).

On the other hand, Tata Sky and Dish TV would be able to offer more channels only if they migrate to the MPEG-4 platform. But that would come at a huge cost since they would have to cajole existing users to shell out more to migrate to these newer set-top boxes.

As broadcasters start offering more content in HD, however, the need for more bandwidth will only rise. Industry experts say with their present capacity, DTH operators can offer only up to a maximum of 280 channels.

“Older players like Dish TV and Tata Sky are on the MPEG 2 platform where more bandwidth is consumed compared to MPEG-4, the format used by newer operators,” concurs Devendra Parulekar, partner, media and entertainment practice, Ernst & Young.

Tata Sky MD and CEO Vikram Kaushik admits that new capacity is definitely an issue. “Spectrum is a limited resource and operators cannot indiscriminately go on adding channels. Newer compression methodologies like MPEG-4 are a reality but operators cannot just jump from one technology to another. There is a cost involved,” he adds.

He believes that as the prices of MPEG-4 set-top boxes (STBs) come closer to that of MPEG-2 boxes, operators might change the boxes but that might not happen in the next five to six years.

Salil Kapoor, chief operating officer of Dish TV, however, says there is no immediate need for switching over to the MPEG-4 technology. “At present, we offer over 250 channels and have added five HD channels. We do not have any capacity constraint with the 12 transponders we currently have,” he says.

Dish TV, though, has an advantage as the Doordardshan channel satellite is in the neighbourhood. Subscribers, therefore, get those channels without any bandwidth consumption on Dish TV’s transponders.

However, Parulekar of Ernst & Young cautions that terrestrial operators (cable operators) might just snatch the baton from DTH operators if they are not able to add channels. “Cable operators can directly relay the feed of local/regional channels whereas DTH operators don’t have a choice but to uplink their entire bouquet of channel offerings,” he points out.

“Changing the STBs does not look like a near time solution as it involves huge cost to replace the STBs of millions of subscribers. Only if the government launches new satellites will the operators have the opportunity to add more channels and offer newer services,” adds Parulekar.

Launched in December 2009, Videocon d2h currently claims a base of 850,000 subscribers.

“We have over 850,000 subscribers and will be reaching one million by June end,” Bharat Business Channel Ltd (Videocon d2h) CEO Anil Khera tells Indiantelevision.com.

The DTH player, which is offering a choice of satellite TV, DVD or a Satellite Box (STB), is seeing growth across the country but faces problems in two southern markets. “Barring Tamil Nadu and Kerala, we are getting good response from the consumers across India. These two states are heavily dominated by Sun,” Khera adds.

To woo more subscribers with extra services, Videocon d2h is also launching Active Music Space, a music offering with two video and 20 audio channels, from 5 June.

The company claims that it is the only service provider to introduce exclusive music channels by launching ‘Active Music Space’ and these features are not available with any other DTH operator.

Says Khera, “These are free on an experimental basis for some time. Later it will be added to our value added services (Vas) bouquet.”

The 20 audio channels are categorised under – Latest Hits, Romantic Hits, DJ mix, Dance Hits, Sentimental Hits, Tanhaee, Zabardast Hits, Love is Hit, Gurbani, Punjabi Devotional, Punjabi Pop, Punjabi Lounge, Bhojpuri, Hamaar Geet, Meditation, Vandana, Spiritual Lounge, Bhakti, Islamic Devotional and Urdu Devotional.

The two video channels will have Latest Hindi Hits and Romantic hits.
